General Terms and Conditions – Rental & Charter

1. Parties

• Progetto M S.r.l., as the lessor, is referred to as the “Owner”
• Client: “Renter”
• Licensed operator: “Captain”

2. Assignment

The Renter cannot transfer the boat or rights under this contract to third parties.

3. Contract Termination

• Renter may withdraw but forfeits deposits.
• Withdrawal is no longer allowed 60 days before rental.
• Owner retains full tariff for late cancellations.
• Interruption of use due to Renter does not entitle reimbursement.
• Owner may provide an alternative boat of similar characteristics within 3 days; reimbursement only for unused days.

4. Owner Obligations

• Boat delivered seaworthy, fully equipped, with safety equipment and documentation.
• Handover confirms boat is in good condition; Renter cannot contest.
• Nautical charts cover only the “recommended area”.
• Delivery is at the agreed place, date, and time; orientation is part of rental period.

5. Renter Obligations

• Renter responsible for the boat throughout rental.
• Must use with care, in accordance with agreed use and technical documents.
• Must navigate within recommended areas; use detailed charts if going elsewhere.
• Return boat on agreed date, time, and place, in same condition.
• Exclusively for recreational use; no commercial use, transport, or racing.
• Comply with crew limits, safety rules, port authority warnings, and weather warnings.
• No pets or children under 5 years allowed.
• Limited personal luggage in soft, foldable bags.
• Responsible for fuel, oil, water, electricity, port fees, radio, and other consumables.
• Maintain the boat and accessories; reimburse Owner for third-party obligations caused.

6. Damage, Breakdowns, Repairs

• Notify Owner immediately; repairs only with authorization.
• Costs borne by Renter unless not their fault.
• Owner may retain deposit until responsibility confirmed.
• Breakdown within recommended area allows time recovery only, no cash reimbursement.

7. Insurance

• Boat insured for total loss in the Mediterranean; deductible covered by deposit.
• Third-party liability insurance applies.
• Loss or damage of Renter’s property not covered.

8. Return

• Return by agreed time, date, and port; failure results in financial penalties.

9. Deposit

• Non-payment results in contract termination; deposit held as penalty.
• Deposit covers material damage; Renter liable for all other damages.

10. Operation of Boat

• Captain responsible for navigation, crew, mooring, and safety.
• Captain can modify itinerary due to weather or safety reasons.
• Misconduct by guests may result in disembarkation.
• Captain not responsible for disputes between Owner and Renter.

11. Breach

• Renter and/or Captain responsible for violations; must indemnify Owner.
• Contractual indemnity applies in case of seizure or detentio caused by Renter.

12. Governing Law

• Contract governed by Civil Code and Navigation Code, except where stated otherwise.

13. Exclusivity

• This is the sole valid contract for renting a Progetto M S.r.l. boat.
• Nullity of individual clauses does not affect the overall contract.

14. Jurisdiction

• Exclusive jurisdiction: Court of Salerno.
